    Options After Sale Date

Your Options With a Scheduled Foreclosure Sale

A foreclosure sale date has been scheduled. This is the most urgent stage. You need an immediate strategy review of your Notice of Default, Notice of Trustee's Sale, loan balances, and available postponement options under California law.

Do Not Wait. Request an Urgent Review Now.

If a foreclosure sale date is already scheduled, do not continue through this guide first. You need an urgent review of your Notice of Default, your Notice of Trustee's Sale, your loan balances, and available postponement options under AB 2424 and California law.

Options Even at This Late Stage

Even with a sale date scheduled, you are not out of options. But the margin for error is gone, and every option below requires immediate attorney review of your specific documents and timeline.

Postponement Under AB 2424 and HBOR

California law and federal rules can require the servicer to pause or postpone a sale under certain conditions, including when a complete loss mitigation application is pending. AB 2424 can provide additional time for qualified homeowners. Eligibility depends on the facts, the timing, and the statutory requirements. Do not assume a postponement is automatic.

    Bankruptcy Consultation

A bankruptcy filing triggers an automatic stay that can halt a foreclosure sale temporarily. Whether bankruptcy makes sense depends on your entire financial picture, your goals, and whether you want to keep or leave the property. This requires separate analysis by a qualified professional.

Emergency Short Sale or Deed in Lieu

In rare cases, a short sale or deed in lieu can still be negotiated before a sale date, but the timeline is extremely compressed. The approval letter or final terms must still mirror California 580b so you do not turn a non recourse situation into a taxable event with the IRS.

    Managed Strategic Default

If the sale cannot be stopped, work with an attorney to protect your money, your taxes, and your credit as much as the facts allow. California's anti deficiency laws may still limit what the bank can pursue, but a sold out junior lien could come after you for the full balance. Never let a first foreclose without an attorney evaluating your junior lien exposure.

Time Is the One Thing You Cannot Get Back

At this stage, every day matters. The further you are from the sale date, the more options remain. The closer you get, the fewer paths survive. Do not try to sort this out alone.

    California State Protections

California homeowners may have state specific foreclosure protections and postponement procedures. Eligibility depends on the facts, the timing, and the statutory requirements. Do not rely on this guide to postpone a foreclosure sale. Speak with an attorney immediately.
